Terms of Service

These Terms of Service (“Terms”) are an agreement between you and Arshia Shahidi, an individual developer based in Türkiye, who operates ActuallyCook (“ActuallyCook”, “we”, “us”). They govern your use of the ActuallyCook website at actuallycook.com (including the waitlist) and the ActuallyCook iOS app — together, the “Service”. By joining the waitlist, creating an account, or using the Service, you agree to these Terms. If you don’t agree, please don’t use ActuallyCook.

01Using ActuallyCook

ActuallyCook lets you turn recipe videos and pasted text into structured recipes, ingredient lists, grocery lists, and a guided Cook Mode. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for lawful, personal, non-commercial cooking purposes and in line with these Terms.

02Eligibility & your account

You must be at least 13 years old (or the minimum age required in your country) to use ActuallyCook. You are responsible for providing accurate information, for keeping your login secure, and for activity that happens under your account. Tell us promptly if you suspect unauthorized use.

03Subscriptions, ActuallyCook Pro & billing

ActuallyCook offers a free tier that includes a limited number of recipe imports, and an optional paid subscription (“ActuallyCook Pro”) that unlocks additional usage. Key terms:

  • Paid subscriptions are sold and billed through your Apple App Store account and are managed by Apple together with our subscription provider.
  • Subscriptions renew automatically for the same period and at the then-current price unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.
  • You can view, manage, or cancel your subscription anytime in your Apple App Store account settings. Deleting the app does not cancel a subscription.
  • Refunds are handled by Apple and follow the App Store’s policies; we generally cannot issue refunds directly.
  • We may change features or pricing for future periods; where required, we will give you notice and the chance to cancel before a change takes effect.

04Your content & intellectual property

Recipes you import and photos you upload remain yours. You grant us a limited, worldwide, royalty-free license to host, process, and display that content solely to operate and provide the Service to you (for example, generating recipes and Cook Mode, and syncing across your devices). You represent that you have the rights to the content you submit.

The ActuallyCook app, brand, mascot, and software are ours and are protected by intellectual property laws. Except for the license granted above, these Terms don’t transfer any of our rights to you.

05Acceptable use

Please don’t misuse the Service. In particular, you agree not to:

  • break the law or infringe anyone’s rights, including intellectual property rights;
  • reverse engineer, scrape, or attempt to disrupt, overload, or gain unauthorized access to the Service;
  • upload content you don’t have the right to use, or anything harmful, deceptive, or malicious;
  • resell or commercially exploit the Service without our written permission.

06Third-party content

ActuallyCook lets you bring in content from third-party platforms and sources. We don’t own that content and aren’t responsible for it. Your use of those platforms and content is governed by their own terms, and you are responsible for ensuring that the content you import and how you use it comply with those terms and with applicable law.

07AI extraction, recipe accuracy & food safety

ActuallyCook uses artificial intelligence to generate recipes, ingredients, quantities, timings, and steps. AI output is inherently imperfect and may be incomplete, inaccurate, or wrong. We do not guarantee that extracted ingredients or any other generated content are correct, and you must not rely on their accuracy. Always verify ingredients and instructions against the original source and use your own judgment when cooking.

Do not rely on ActuallyCook for food-safety, dietary, medical, or allergen decisions. Check labels and the original recipe yourself — especially regarding allergens, intolerances, cooking temperatures, and food handling. ActuallyCook is a convenience tool, not a substitute for professional, nutritional, or medical advice. To the fullest extent permitted by law, we accept no responsibility or liability for inaccuracies in generated content or for any outcome arising from your reliance on it.

08Disclaimers & limitation of liability

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including fitness for a particular purpose. We don’t guarantee that generated recipes, timings, or ingredient lists are complete or accurate, or that the Service will be uninterrupted or error-free.

To the fullest extent permitted by law, ActuallyCook will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any cooking, health, or food-related outcomes arising from your use of the Service. Where liability cannot be excluded, our total liability is limited to the amount you paid us for the Service in the 12 months before the claim.

09App Store (Apple) terms

The following applies because you obtain the app through the Apple App Store:

  • These Terms are between you and ActuallyCook only, not Apple. Apple is not responsible for the app or its content.
  • Apple has no obligation to provide maintenance or support for the app. We — not Apple — are responsible for support and for addressing any product or warranty claims to the extent set out in these Terms.
  • Apple is not responsible for any third-party claims that the app or your use of it infringes intellectual property rights; we are responsible for handling such claims as set out in these Terms.
  • You represent that you are not located in a country subject to a U.S. government embargo and are not on any U.S. government restricted-party list.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

10Termination

You can stop using ActuallyCook at any time, and you can request deletion of your account and data by contacting us. We may suspend or terminate access if these Terms are violated or to protect the Service or other users. Provisions that by their nature should survive termination (such as content licenses, disclaimers, and liability limits) will continue to apply.

11Changes to these terms

We may update these Terms as the product evolves. When changes are material, we’ll update the date above and notify you where appropriate. Continued use of the Service after changes take effect means you accept the updated Terms.

12Governing law

These Terms are governed by the laws of the Republic of Türkiye, without regard to its conflict-of-laws rules, and any disputes will be handled in the courts located in Türkiye, except where applicable law gives you the right to bring a claim in your country of residence.
